Battery Waste EPR
Introduction
- Application : Producer, dealer, consumer, entities involved in collection, segregation, transportation, re-furbishment and recycling of Waste Battery.
- Types of Battery : All types of batteries regardless of chemistry, shape, volume, weight, material composition and use.
- Producer : i. Manufacture and sale of Battery including refurbished Battery, including in equipment, under its own brand
ii. Sale of Battery including refurbished Battery, including in equipment, under its own brand produced
by other manufacturers or suppliers
iii. Import of Battery as well as equipment containing Battery - Functions of Producer : i. Producer shall provide Extended Producer Responsibility plan in the Form 1(C) to Central Pollution Control Boby 30th June of every year for the Battery manufactured in the preceding financial year. It shall contain informathe quantity, weight of Battery along with the dry weight of Battery materials through the centralised portal.
ii. Producer may engage itself or authoriseany other entity for collection, recycling or refurbishment of Waste Badhere to prohibitions and labelling requirements as prescribed in Schedule I;
iii. imported Battery, the Producer shall have to meet the obligation of the minimum use by way of getting suchquantity of recycled materials utilised by other businesses or by way of exporting such quantity of recycled matProducer shall not deal with any other entity not having registration mandated under these rules. - Types of Producers : i. Manufactures and Sells new battery under its own brand name
ii. Manufactures and sells new battery in equipment under its own brand name
iii. Manufactures and sells refurbished battery in equipment under its own brand name
iv. Manufactures and sells refurbished batteryb under its own brand
v. Manufactures new battery & sells to other manufacturers under their own brand name or no brand name
vi. Sells refurbished Battery refurbished by others under its own brand name
EPR Target
Producer will meet their Extended Producer Responsibility obligation through the Extended Producer. Responsibility certificate made available by recycler or refurbisher. In case of non-availability of Extended Producer Responsibility certificates with recyclers or refurbishes, the Producer shall have the responsibility of collection as well.
- Automotive battery : 2022-23 – 30% | 2023-24 – 50%
- Industrial battery : 2022-23 – 40% | 2023-24 – 50%
- Battery of E-rickshaw : 2024-25 – 70% | 2025-26 -70%
- Battery of 2 wheelers : 2026-27 – 70% | 2027-28 -70%
- Battery of 4 wheelers : 2029-30 – 70% | 2030-31 -70%
Environmental Compensation
Environmental Compensation levied shall be returned to the Producer.
Within one year of levying of Environmental Compensation: 75 percent return;
Within two year of levying of Environmental Compensation: 60% return;
Within three year of levying of Environmental Compensation: 40% return;
Prohibitions on heavy metal content in the Battery
- Battery that contains up to 0.0005% (5 ppm) of mercury by weight may only be placed till 2025;
- Battery that contains up to 0.002% (2000 ppm) of cadmium by weight may only be placed.
Conditions & Cancellation of Registration
Conditions
- The Producers shall not carry any business without having registration through online centralized portal developed by CPCB.
- The Producers shall not deal with any entity not registered through online centralized portal developed by CPCB to meet EPR targets.
- In case, it is found or determined that any Producer registered on the online portal has provided false information or has willfully concealed information or there is any irregularity or deviation from the conditions stipulated while obtaining registration under BWM Rules, 2022, then the registration of such an entity would be revoked for a one –year period after giving an opportunity to be heard. The entities whose registration has been revoked shall not be able to register afresh for the period of revocation.
- The Producers shall fulfill the year-wise / category-wise EPR Target as specified in Schedule II of the BWM Rules, 2022.
- The Producers are required to comply with provisions of BWM Rules, 2022 failing to which necessary action as deemed fit shall be initiated against the violator.
Cancellation
- Registration granted to Producers/Manufacturer is liable to be canceled or suspended at any stage, if the document submitted by the Producers/Manufacturer is found to be false.
- CPCB shall suspend and/or cancel the registration, and/or impose Environmental Compensation, in case of non-compliance of Extended Producer Responsibility obligations asper Schedule II.
- Central Pollution Control Board shall suspend and/or cancel the registration of the Producer, and/or impose Environmental Compensation in case of violation of Battery Waste Management Rules, 2022 by the registered entity.
- An opportunity will be given to hear the Producer/Manufacturers within fifteen days from the date of issuance of notice; prior to considering the case for cancellation or suspension of Registration by CPCB.
- The Joint Secretary or the officer equivalent in the Ministry of Environment, Forest and Climate Change shall be designated as an Appellate Authority.
